Terms & Conditions
The following terms and conditions apply to all deliveries from Ergolash ApS, (VAT: DK37855480) for customers ordering goods at our online shop www.ergolash.dk
1. FINAL CONTRACT
There is a final and binding agreement between you and Ergolash ApS when your order has been confirmed by Ergolash ApS. Ergolash ApS sends an invoice to you by e-mail when the order has been accepted and shipped. The receipt for the order, which is received immediately after your submission of the order, does not constitute an order confirmation.
You can buy products at Ergolash ApS online shop as a private consumer and as a business customer. Business customers (outside Denmark) can buy VAT free if they have a valid VAT number that can be verified in VIES database.
2. PRICES, FEES AND SHIPPING
All prices shown in the webshop are inclusive taxes. Shipping cost is added according to informations given at the online shop. The current price is the one stated on Ergolash ApS online shop for the product concerned on the date of the ordering.
Ergolash ApS reserves the right to change prices that may have been incorrectly stated on Ergolash ApS online shop. Ergolash ApS reserves the right to change prices, fees and/or other costs stated on Ergolash ApS online shop at any time.
Shipping costs will be calculated at checkout based on your delivery address. Depending on your address and type of products the rate will differentiate. We use several carriers for shipping your goods depending on your address.

3. DELIVERY
All orders placed, and accepted by Ergolash ApS will be processed within 1-2 working day. Delivery time is 2-7 working days depending on your address. All orders will be shipped according to agreements.
Once your order is dispatched from Ergolash ApS, you will be notified via the email address that you provided during checkout. The notification email is sent from the freight forwarder, and includes details about your unique tracking ID. All packages are sent from Ergolash ApS business address.
Ergolash ApS reserves the right to exclude persons from purchasing through Ergolash ApS online shop.
Ergolash ApS is not obliged to deliver goods that are sold out of stock.
4. TAXES, VAT AND DUTIES
When applicable, it is the customer's responsibility to pay any relevant fees, taxes, and/or duties in the country of import. Ergolash ApS is not responsible for any shipping delays caused by outstanding import taxes.
Business customers (outside Denmark) can buy VAT free if they have a valid VAT number that can be verified in the VIES database. Any attempt of fraud using a fake or invalid VAT number will be reported to the authorities.
5. INSURANCE
Shipments are sent without insurance and Ergolash ApS cannot be held accountable for any lost packages.
6. RETURN AND EXCHANGE POLICY
You have the right to cancel your purchase.
The right of cancellation applies for 100 days and the period is calculated from the day you received the goods.
If the last day to use the right of withdrawal is on a Saturday, Sunday, public holiday, constitution day, December 24 or December 31, the deadline expires on the following working day.
The cancellation deadline is met if you send an email notice that you wish to cancel your purchase to mail@ergolash.dk before the withdrawal period has expired.
The product must be returned to Ergolash ApS no later than 100 days from the date you have informed us that you wish to use the right of cancellation.
The product must be returned in unused condition and in original packaging.
We do not accept returned items if they:
- Do not include orginal packaging.
- Do not include all orginal items.
- Original packaging has been severely damaged.
- Products have been used and have visible scratches, wear and tear.

The purchaser is responsible for the cost/carriage of the items to be returned.
7. WARRANTY
All goods are sold with warranty according to your statutory rights, which apply for the original purchaser only. Any claims on warranty require proof of purchase. Please read Warranty Information Extended below for more information.
8. FAULTY GOODS
Ergolash ApS grants a warranty period of 12 months for all goods under the Sale of Goods Act. The warranty means that you can complain about construction defects and deficiencies of the goods within 12 months from the receipt of the goods. Therefore, the warranty does not apply to wear and tear or if a product has been used inappropriately. If you wish to complain about a product, please contact us immediately after you have discovered the error by sending pictures and description to mail@ergolash.dk
We take complaints very seriously. If you feel that we really have fallen short of your expectations, please mail us at mail@ergolash.dk and we will listen to what you have to say and respond within 14 days.
9. DISPUTE RESOLUTION
Any dispute and any agreement and purchases made in relation to Ergolash ApS are subject to Danish law and shall be resolved by the Danish courts unless otherwise determined by mandatory law.
WARRANTY INFORMATION EXTENDED
Ergolash ApS is confident of the quality of its products and offers an outstanding warranty. This statement is in addition to and in no way prejudices your statutory rights. The warranty is valid within the territories of the Member States of the European Union and the European Free Trade Area.
If you experience any problems with a Ergolash ApS product, the information below will help you with getting it repaired or replaced as quickly as possible.
If your Ergolash ApS product becomes defective due to faulty materials, workmanship or lack of conformity, within 24 months from the date of purchase, Ergolash ApS guarantees to replace defective parts, repair products subjected to fair wear and tear or replace such tool to ensure minimum inconvenience to the customer unless:
- The tool or equipment has been subjected to misuse or neglect;
- The tool or equipment has sustained damage through foreign objects, substances or accidents;
- Repairs have been attempted by persons other than authorised repair agents or Ergolash® service staff.
OTHER LIMITATIONS IN THE WARRANTY
Normal wear, abrasion, misuse, alteration, abuse or taking apart of the product are not covered. This warranty does not cover damage caused by improper care, accidents, prolonged UV exposure, or the natural breakdown of certain materials over long periods of time. Ergolash ApS will not be liable for incidental or consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply. Shipping charges to Ergolash ApS for a defective product are not covered.
HOW TO OBTAIN WARRANTY SERVICE
To claim on the warranty, you will need to submit proof of purchase to the seller or an authorised repair agent. You can find a list of authorised repair agents below.

LIMITED WARRANTY/LIMITATIONS OF REMEDIES AND LIABILITY
Limited Warranty. Ergolash ApS, to the original owner (“Owner”), under intended use and maintenance, warrants the enclosed product (“Product”) to be free from defects in materials and workmanship within 24 months from the date of purchase. No warranty against defects in materials and workmanship will apply if Product is (i) altered in any way, (ii) used for purposes inconsistent with Product’s intended purpose or design, or (iii) improperly maintained. Warranty will furthermore be voided where Owner/user (i) failed to follow Product instructions or warnings or (ii) subjected Product to misuse, abuse, or neglect.
During the warranty period, original Product parts determined by Ergolash ApS to be defective in materials or workmanship will be repaired or replaced as Owner’s sole remedy. Ergolash ApS reserves the right to replace any discontinued product with a new product of comparable value and function. A returned product deemed irreparable becomes the property of Ergolash ApS and will not be returned.
EXCLUDING THE LIMITED WARRANTY PROVIDED ABOVE, DYNELLO, ITS AFFILIATES AND THEIR SUPPLIERS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, AND DISCLAIM ALL WARRANTIES, DUTIES AND CONDITIONS, WHETHER EXPRESSED, IMPLIED OR STATUTORY, WITH RESPECT TO THE PRODUCT, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, AGAINST LATENT DEFECTS, FITNESS FOR A PARTICULAR PURPOSE, OR CORRESPONDENCE TO DESCRIPTION.
WARRANTY SERVICE
To obtain service under this warranty, the warranty-eligible Product must be presented to a Ergolash ApS authorized dealer or repair agent.
Owner is responsible for all costs associated with returning Product to Ergolash ApS for service. Where at its sole discretion Ergolash ApS deems Product eligible for warranty repair or replacement, Ergolash ApS will pay the shipping and handling associated with returning repaired or replaced Product to Owner. In instances where Ergolash ApS deems a returned product ineligible for warranty service, Ergolash ApS will, if possible, repair product for a reasonable charge that includes return shipping and handling.
LIMITATION OF REMEDIES
Should a court of competent jurisdiction find the limited warranty set forth above breached, Ergolash ApS’ only obligation will be to, at its option, either repair or replace Product. Should the aforementioned remedy fail of its essential purpose, Ergolash ApS will, in exchange for return of Product, refund to Owner Product’s original purchase price.
THE FOREGOING REMEDY IS THE SOLE AND EXCLUSIVE REMEDY OF THE PURCHASER AGAINST Ergolash ApS, ITS AFFILIATES AND THEIR SUPPLIERS, REGARDLESS OF LEGAL THEORY.
LIMITATION OF LIABILITY
Ergolash ApS´, its affiliates’ and their suppliers’ maximum liability is limited to incidental damages not to exceed the original purchase price of the Product.
ERGOLAS APS, ITS AFFILIATES AND THEIR SUPPLIERS HEREBY DISCLAIM AND EXCLUDE ANY LIABILITY FOR ANY CONSEQUENTIAL OR OTHER DAMAGES RESULTING FROM ANY REASON WHATSOEVER. THIS EXCLUSION AND LIMITATION APPLIES TO ALL LEGAL THEORIES UNDER WHICH DAMAGES MAY BE SOUGHT, AND WILL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
This limited warranty gives Owner specific legal rights; Owner may have additional rights, which may vary state to state.
Always completely follow safety, use, operation, and maintenance instructions for this or any other Ergolash ApS product.
European Union customer statutory rights are not affected.
